This is the manual of Intellitics Business Solutions under section 51 of the Promotion of Access to Information Act, 2000 (PAIA). Every private body in South Africa must have one available at its principal place of business or on its website — the exemption that previously covered smaller private bodies ended on 31 December 2021.

2. The PAIA guide

The Information Regulator has compiled a guide, in terms of section 10 of PAIA, on how to use the Act. It is available from the Regulator at inforegulator.org.za, or by contacting them at JD House, 27 Stiemens Street, Braamfontein, Johannesburg 2001.

3. Records available without a formal request

The following are freely available on our website and need no PAIA request: our privacy notice, our terms of service, our operator agreement, our cookie notice, and our published product and pricing information.

We do not hold customer vault contents as our own records. Those belong to the customer, who is the responsible party for them.

5. How to request a record

  1. Complete the prescribed request form (Form 2 for a private body) and send it to the Information Officer at the address above.
  2. Provide enough detail to identify the record and to enable us to identify you, and state the form of access you want.
  3. If you are requesting the record to exercise or protect a right, say which right and how the record helps.
  4. Pay the prescribed request fee where one applies.
  5. We will decide within 30 days and tell you in writing. If we need more time, we will say so and explain why. If we refuse, we will give reasons and explain how to appeal.

6. Fees

Fees are those prescribed under PAIA and are payable before access is given. We will quote you before doing any work that attracts a fee. Personal requesters seeking records about themselves do not pay a request fee, though reproduction fees may apply.

7. Grounds on which we may refuse

We must refuse access in the circumstances set out in Chapter 4 of Part 3 of PAIA, including where the record contains someone else's personal information, commercial information of a third party, information subject to legal privilege, or information whose disclosure would prejudice research or endanger a person or property. Where a record can be severed, we will give you the part we can.

8. Remedies

If we refuse a request or fail to answer in time, you may lodge a complaint with the Information Regulator, or apply to a court. There is no internal appeal against a decision of a private body.
